Board of Appeals Minutes - October 25, 1995 <br />He suggested the owner was due at least 3 lots. Mr. Govoni explained that there may be <br />new zoning changes proposed for the May Town Meeting. Mr. Slavinsky asked for a <br />recess which was granted. <br />The hearing resumed after the Asdourian hearing. Ms. Stankowski asked if the Board <br />could approve three lots and Mr. Govoni explained that the hearing was advertised for <br />two lots only. He said that the Briarwood Assoc. had no objection to two lots. Mr. <br />Govoni explained that the original zoning only protected three lots and that owners with <br />four contiguous lots had to combine them. Mr. Regan stated that developers knew that <br />the lots should be held in separate names but many owners did not realize this. <br />Mr. Regan moved to continue the hearing to December 13. Ms. Hawver seconded. All <br />agreed. <br />George K. and Christine G. Asdourian - Request a Variance from Section 174-31 of the <br />Zoning By-laws for permission to vary the setback and lot coverage requirements in an R- <br />3 zoning district on property located at 62 Tide Run (Map 125, Block 206) Masbpee, <br />MA. The applicants propose to construct a swimming pool 7' from the rear property line <br />and a shed 8.3' from the side property line. <br />• Members sitting: E. Govoni, J. Regan, R Nelson <br />Engineer Michael Grotzke represented the applicant and explained that the lot borders <br />reserve land. The Board noted that the driveway encroached on the reserve land. Mr. <br />Nelson explained that the shape of the pool required additional space over a conventional <br />pool. Mr. Govoni explained that the proposal was similar to many in the neighborhood <br />and would not be a detriment. Mr. Regan moved to grant a Variance of 13' in the rear <br />setback and a right setback of 6.7' and a lot coverage increase of 0.8%. Mr. Nelson <br />seconded. All agreed. The Board noted that the Decision should read that the plans of the <br />pool are accepted but the encroachment of the driveway was not approved. <br />Bernard & Zelda Pemstein <br />The Board was informed that Thomas Demelio, builder, had Sled a Variance application <br />for the Pemsteins for a sideline setback. After the submission of new engineer's plans, the <br />Building Inspector determined that a Variance was not needed and Mr. Demelio was filing <br />a withdrawal request. Mr. Nelson moved to grant the withdrawal without prejudice. Mr. <br />Regan seconded. Mr. Govoni agreed. <br />
