Donahue SP-95-5 428 Nathan Ellis Highway <br /> Map 72, Block 86 <br /> A Petition was filed by Daniel J. Donahue of Mashpee, Massachusetts on <br /> November 28, 1994 for a Special Permit under Sections 174-17, 174-21, 174-25.E.8, <br /> 174-25.F.5, 174-25.G.9, 174-25.H.6 and 174-82 of the Zoning By-laws for permission to <br /> construct an additional building on a non-conforming commercial lot. The applicant <br /> proposes to continue the present use of the premises for contractor's storage and repair <br /> and add a retail/wholesale garden supply business in the proposed building. The site is <br /> located on Route 151 in a C-2 zoning district at 428 Nathan Ellis Highway(Map 72, <br /> Block 86)Mashpee, MA. (Owner of record: Eugene E. Labute). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in the Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee on December 23 and December 30, 1994, a <br /> copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 11, 1995 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: James E. Regan III, Cheryl A. <br /> Hawver and Kenneth E. Marsters. The hearing was continued to February 22, 1995 and <br /> taken under advisement to March 29, 1995. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Sections 6 and 9 and Sections <br /> 174-17, 174-21, 174-25 and 174-82 of the Mashpee Zoning By-laws. <br />
