Board of Appeals Daniel J. Donahue SP-95-5 2. <br /> Architect Allen Osgood represented the applicant and presented preliminary plans <br /> for a wholesale/retail garden supply business. The Board voted to continue the hearing <br /> upon receipt of engineer's plans, landscape design, drainage and parking plans. The <br /> hearing was continued on February 22, 1995 with Mr. Osgood, Attorney James MacNeill <br /> and Engineer Paul Rylll representing the applicant. Revised plans were submitted for a <br /> single entrance drive, smaller building, a stormwater drainage system. Landscape and sign <br /> plans were submitted to the Board at the March 29, 1995 meeting and are subject to the <br /> approval of the Design Review Committee. The proposed sign will be located 10 feet <br /> from the lot line. <br /> Special Permit Criteria- Section 9 of Chapter 40A requires that the special permit <br /> granting authority make the finding that.the use is in harmony with the general purpose <br /> and intent of the by-laws and complies with the provisions set forth therein. Section 6 of <br /> Chapter 40A requires the additional finding that any extension, alteration or change to a <br /> pre-existing non-conforming use or structure shall not be substantially more detrimental to <br /> the neighborhood than the existing non-conforming use. <br /> FINDINGS <br /> A. General <br /> 1. The property is an approximately 60,548 square foot lot with 125 feet of <br /> frontage on Nathan Ellis Highway(Route 151). The lot is within the <br /> commercial zoning district. <br /> 2. The property has been improved with a garage style building constructed <br /> approximately 1950 which has been used for contractor's storage. <br /> 3. The Petitioner has a Purchase and Sales Agreement with the current owner, <br /> Eugene E. Labute. <br />
