Mellian and Rose Z. Karibian for a Variance V-95-12
A Petition was filed by Alice K. Mellian and Rose Z. Karibian of Watertown,
Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission
to vary the minimum lot size in an R-3 zoning district for property located at 48 Nehoiden
Road (Map 125, Block 117)Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts General Laws
Chapter 40A. Notice was given by publication in The Enterprise, a newspaper of general
circulation in the Town of Mashpee, on January 20 and January 27, 1995, a copy of which
is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, February 8, 1995 at 7:30 P.M. at which time the following members of the
Board of Appeals were present and acting throughout: Edward M. Govoni, James E.
Regan III and Kenneth E. Marsters.
Attorney Kevin M. Kirrane represented the Petitioners and informed the Board
that Ms. Mellian and Ms. Karibian had purchased two lots in South Cape Beach estates in
1969 and constructed a home on one of them in 1972. He explained that the vacant lot
had been held in separate ownership since it was purchased and that the owners were not
aware of the Mashpee By-law change in 1990 which limited the use of adjacent land in
common ownership. He stated that the Building Inspector had recommended that they
seek Variance relief.
