Board of Appeals Alice K. Mellian and Rose Z. Karibian 2. <br /> Comments were received from two abutters in favor the Petition. <br /> The Board of Appeals made the following findings: <br /> 1. the subject property consists of 13,114 square feet and has frontage on <br /> both Nehoiden and Wamesit Roads. The area is now serviced by a <br /> public water supply and can accommodate the installation of a typical <br /> Title V septic system. <br /> 2. the subject property is shown on the South Cape Beach Subdivision <br /> Plan 26502B filed in the Land Could on July 7, 1969. The subdivision <br /> was in an R-100 zoning district which required lot size of 10,000 <br /> square feet and frontage of 100 feet. <br /> 3. the lot has been separately maintained on the Assessor's Records and <br /> was assessed as a buildable lot through 1994 at $46,400. <br /> 4. the Board determined that, absent relief, the lot could not be used for a <br /> residence, the purpose for which it had been laid out and for which the <br /> balance of the lots in the subdivision were being used. <br /> 5. the Board found that a literal enforcement of the By-laws would <br /> produce a substantial hardship. The hardship relates to the size and <br /> circumstances of said lot being bounded by two ways and clearly <br /> intended to stand on its own and not as part of the adjacent developed <br /> land. <br /> 6. the Board found that the granting of a Variance would not derogate <br /> from the intent of the By-laws nor would it be a detriment to the <br /> neighborhood. <br /> Upon motion duly made and seconded, the Board of Appeals voted <br /> unanimously on February 8, 1995 to grant a Variance in lot size to permit the <br /> construction of a single family dwelling on a 13,114 square foot lot at 48 Nehoiden <br /> Road (Map 125, Block 117). <br />
