<Board of Appeals E. Gerard Keen - SP-95-23 2. <br /> The Board of Appeals made the following findings: <br /> 1. the subject lot contains 18,314 square feet and is located at 426 Monomoscoy <br /> Road. <br /> 2. in the proposed location, the addition will not encroach on the sideline setbacks <br /> nor increase the non-conformity created by the existing deck. <br /> 3. the planned expansion would be an improvement to the property with the <br /> replacement of the septic system and installation of a drywell for roof runoff. <br /> 4. the site is both adequate and suitable for the proposed use. <br /> For the foregoing reasons, the Board of Appeals determined that the applicant met <br /> the criteria necessary to grant a Special Permit. The Board found that the proposed <br /> expansion would not be a detriment to the neighborhood and the proposed addition, its <br /> location on the lot, and the intended use of the structure comply with the general <br /> provisions set forth within the By-laws. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> February 8, 1995 to grant the Special Permit. The Permit is subject to the approval of the <br /> Mashpee Conservation Commission and will require a modification if the referenced plans <br /> are changed. The Permit is referenced by plans of Cape and Islands Engineering dated <br /> December 22, 1994. <br /> i <br />
