Board of Appeals Mashpee High School Building Committee V-95-18 2. <br /> A. Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the by-laws would <br /> involve hardship to the petitioner. <br /> B. Findings: <br /> 1. the subject property is located at 500 Old Barnstable Road and contains <br /> 183,000 square feet. <br /> 2. there is adequate land area to accommodate the high school and adjacent <br /> parking areas <br /> 3. the building has been designed for the shape and topography of the lot and the <br /> extra height will not be a detriment to the area. The auditorium and academic <br /> areas on the second floor require the additional height in order to <br /> accommodate the high point of their sloping roofs. <br /> 4. the size of the parking spaces is consistent with recent Variances granted for <br /> shopping centers and is adequate for the site. The proposed size will reduce <br /> the overall site development and project costs. <br /> 5. the Board determined that desirable relief may be granted without derogating <br /> from the intent or purpose of the Zoning By-laws and without detriment to the <br /> public good. <br /> 6. the shape and topography affect this lot and not the zoning district in which it <br /> is located. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Variance. Upon motion duly made and <br /> seconded, the Board voted unanimously to grant the Variance allowing an increase in <br /> building height from 35' to 40' and a reduction in the size of the parking spaces from 9' x <br /> 20' to 9' x 18'. The Variance is referenced by plans of Symmes Maini dated January 5, <br /> 1995. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Mashpee Zoning By-laws. <br />
