Realty Trust-Requests a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the setback requirements in an R-3 zoning district on property located at 240 <br /> Surf Drive(Map 102, Block 37)Mashpee, MA. (Owner of record: Vincent Porciello.) <br /> Members sitting: E. Govoni, C. Hawver,K. Marsters <br /> Mr. Regan stepped down for this hearing, Engineer John Slavinsky represented the applicant and <br /> explained that the Conservation Commission had requested that the proposed house be located <br /> 50' from the wetlands in the rear. This resulted in a 25' front setback in an area requiring a 30' <br /> setback. Mr. Govoni read memo from Conservation requesting approval of the Variance. Mr. <br /> Slavinsky stated that Seabrook Village has covenants on minimum setbacks which they have <br /> varied on other lots. <br /> Frances LeBaron, an abutter, questioned if the Seabrook Village Association had been notified <br /> and Mr. Govoni reviewed the abutter list and found that four mailings had been sent. Mr.. <br /> LeBaron said he would rather not have a house there. <br /> Mr. Marsters moved to grant the Variance of 5' due to the topography of the land and the <br /> request of the Conservation Commission. Ms. Hawver seconded. All agreed. <br /> Ruth A. and James A. Warner Jr. TRS. -Request a Special Permit under Sections 174-17 and <br /> 174-20 of the Zoning By-laws to replace a house damaged by fire with a new dwelling and <br /> garage and relocate an existing cottage on property located in an R-3 zoning district at 71 <br /> Seconsett Island Road (Map 119,Block 104)Mashpee,MA. <br /> Members present:: E. Govoni, J. Regan,K. Marsters and C. Hawver. <br /> Henry Miller,Builder, represented the applicant and stated that the Board of Appeals had <br /> approved rebuilding but that the Board of Health did not approve. He presented plans for the <br /> rebuilding of an existing cottage and a proposed new dwelling and garage. <br /> Mr. Govoni read a memo from a direct abutter,Michael Scolavino,in opposition to the <br /> application. Janice and Frank Strazzulo, direct abutters, reviewed the plans and stated that the <br /> cottage on the plans was located on their property. Mr. Strazzulo questioned the measurements <br /> on the plans. Mr. Govoni asked if the cottage was to be upgraded and Mr. Warner said he <br /> would eventually. Mr. Govoni suggested that Mr. Warner meet with the abutter and agree on <br /> improvements. He asked for elevations of the proposed structure. <br /> Mr. Govoni moved to take the application under advisement. Mr. Marsters seconded. All <br /> agreed. <br />
