Board of Appeals Steven R. and Bonnie Croopnick- V-95-34 2. <br /> Findings: <br /> A. General <br /> 1. the subject property is located at 2 Waterline Drive North (Map 120, Block <br /> 173) and consists of 15,500 square feet fronting on Jehu Pond. <br /> 2. the immediate neighborhood consists of single family homes of similar size. <br /> Many of the homes in the area have been improved with additions or garages. <br /> 3. the addition of a garage will result in lot coverage of 27% excluding the <br /> wetlands. <br /> B. Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the Petitioner. <br /> C. Specific Findings <br /> 1. the subject property fronts on Jehu Pond and includes 4,375 feet of wetlands <br /> which cannot be developed creating a hardship in the use of the land. <br /> 2. the triangular shape of the lot is an unusual one in this zoning district. <br /> 3. the proposed location is the only place on the lot where an addition could be <br /> constructed which would not encroach on the septic system or the wetlands. <br /> 4. the shape and topography affect this lot and not the zoning district in which it. <br /> is located. <br /> 5. the Board determined that desirable relief may be granted without derogating <br /> from the intent and purpose of the Zoning By-laws and without detriment to <br /> the public good. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a.Variance. Upon motion duly made and <br /> seconded, the Board of Appeals voted unanimously on May 24, 1995 to grant a Variance <br /> of 18 feet to allow for a front setback of 12 feet, a Variance of 1 foot to allow for a side <br /> setback of 14 feet on the Northerly side and a Variance in lot coverage to allow for a <br /> coverage of 27% of the lot excluding the wetlands. The Variance is referenced by plans of <br /> Michael H. Grotzke revised May 22, 1995. <br />
