Board of Appeals Arthur B. Burnes V-95-33 2. <br /> Findings: <br /> A. General <br /> 1. the subject property is located at 13 Compass Circle (Map 105, Block 257)and <br /> consists of 21,783 square feet fronting on Popponesset Creek. <br /> 2. the immediate neighborhood consists of single family homes of similar size. <br /> Many of the homes in the area have been improved with additions or garages. <br /> 3. the addition of a garage will result in lot coverage of 16.1% and is within the <br /> 20% allowed in the by-laws. <br /> B. Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the Petitioner. <br /> C. Specific Findings <br /> 1. the subject property fronts on Popponesset Creek and is impacted by wetlands. <br /> 2. the irregular shape of the lot prevents any alternative location for the garage. <br /> 3. the shape and topography affect this lot and not the zoning district in which it <br /> is located. <br /> 4. the Board determined that desirable relief may be granted without derogating <br /> from the intent and purpose of the Zoning By-laws and without detriment to <br /> the public good. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Variance. Upon motion duly made and <br /> seconded, the Board of Appeals voted unanimously on April 12, 1995 to grant a variance <br /> of 2.4 feet on the northwest corner of the garage allowing a sideline setback of 7.6 feet. <br /> The Variance is referenced by revised plans of Michael Grotzke dated April 12, 1995. <br />
