l Board of Appeals Walter S. Wightman V-95-39 2. <br /> Findings: <br /> a. General <br /> 1. the subject property is located at 419 Monomoscoy Road (Map 124, Block 58) and <br /> consists of 16,300 square feet fronting on Little River. <br /> 2. the immediate neighborhood consists of single family homes many of which have a <br /> dock on Little River. <br /> 3. the proposed dock will be accessory to an existing dwelling and is a permissible use <br /> within the R-3 zoning district. <br /> b. Variance Criteria: <br /> Section 10 of Chapter 40A requires that the permit granting authority determine that <br /> there are circumstances relating to the shape and topography which affect this lot and not <br /> the district in which it is located and that a literal enforcement of the by-laws would <br /> involve hardship. <br /> c. Specific Findings: <br /> I. the subject property fronts on Little River and is substantially impacted by the location <br /> in the coastal wetlands. <br /> 2. the shape and topography of the lot prevent the placement of the dock in any.other <br /> location. <br /> 3. the unusual topography affects this lot and not the district in which it is located. <br /> 4. the Harbormaster and the Conservation Commission have determined that the <br /> extended length of the dock will be an improvement with less impact on the marine <br /> environment. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> May 24, 1995 to grant the Variance allowing for a pier, ramp and float with a total length <br /> of 99 feet. The change from 97 feet to 99 feet was determined by revised engineering <br /> plans. The Variance is referenced by plans of Holmes and McGrath, Inc. revised April <br /> 18, 1995. <br />
