SNt�TON7y� <br /> town of fTagbpee <br /> f; GG 4 <br /> 16 GREAT NECK ROAD NORTH <br /> •'••'"'• MASHPEE, MA 02649 <br /> SABLE CO" <br /> BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Donna Bochanowski for a Variance V-95-49 19 John Ewer Road <br /> Map 2, Block 132 <br /> A Petition was filed on June 15, 1995 by Donna Bochanowski of Mashpee, <br /> Massachusetts for a Variance from Section 174-32 of the Zoning By-laws to allow the <br /> construction of a single family home on an unpaved road in an R-5 zoning district on <br /> property located at 19 John Ewer Road (Map 2, Block 132)Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on July 7, 1995 and July 14, 1995, a copy <br /> of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 26, 1995 at 7:30 P.M. at which time the following members of the Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, Kenneth E. Marsters <br /> and Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-32 <br /> of the Mashpee Zoning By-laws. <br /> Attorney Kevin M. Kirrane represented the applicant and informed the Board that <br /> John Ewer Road is a public way which appears in a 1907 atlas and was known as <br /> Falmouth-Barnstable Road. He informed the Board that the lot was created by an <br /> Approval Not Required Plan and that this lot and an adjoining lot have been held in <br /> separate ownership since 1986 and conformed to zoning at the time they were formed. He <br /> noted that the road had been used by the Fire Department for access to Peter's Pond to <br /> refill tank trucks. <br /> 9 <br />
