Board of Appeals Donna Bochanowsld V-95-49 2. <br /> Comments were received from abutters who objected to construction on the road <br /> and were concerned about the possible development of other land on the road. The Board <br /> was informed that a telephone pole was located near the center of the road. <br /> FINDINGS: <br /> a. General <br /> 1. the subject property is located at 19 John Ewer Road and contains <br /> approximately 55,326 square feet and has frontage of 236 feet. <br /> 2. the unpaved John Ewer Road is accessible to vehicular traffic and is typical of <br /> many of the unpaved roads in the Town. <br /> 3. the lot has been maintained as a separate buildable lot on the assessor's <br /> records. <br /> 4. the lot's southerly lot line is situated approximately 287 feet from the improved <br /> Town Road, Pimlico Pond Road. <br /> 5. a fire hydrant is located close to the intersection of John Ewer and Pimlico <br /> Pond Roads and is readily accessible to the subject lot. <br /> b. Variance Criteria <br /> Section 174-32 of the Town of Mashpee Zoning By-laws is designed to ensure <br /> that there will be proper and safe access to properties via roads capable of supporting <br /> emergency vehicle traffic. <br /> c. Specific Findings <br /> 1. John Ewer Road has existed for more than eighty years and provided public <br /> access to the State Boat Ramp and as access to Peters Pond. <br /> 2. the site distances as well as the width of the roadway are adequate to provide <br /> safe access for emergency vehicles. <br /> 3. the lot size is consistent, if not greater than other lots in the area and the <br /> proposed use is also consistent with the neighborhood. <br /> 4. without variance relief the lot cannot be used for a residence, the purpose for <br /> which it had been laid out . <br /> 5. the Board found that a literal enforcement of the By-laws would result in <br /> substantial hardship to the owner. <br />
