' Board of Appeals Donna Bochanowski V-95-49 3. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> September 13, 1995 to grant a Variance from Section 174-32 of the Zoning By-laws to <br /> allow the construction of a single family home on an unpaved road at 19 John Ewer Road <br /> (Map 2, Block 132) subject to the following conditions: <br /> 1. the telephone pole is to be relocated to the side of John Ewer Road. <br /> 2. the owner of 19 John Ewer Road (Map 2, Block 132), also known as Lot 3B, <br /> shall be required to obtain a perpetual easement to pass and re-pass over land <br /> known as lot 3A located at 123 Pimlico Pond Road (Map 2, Block 13 1)within <br /> the boundaries of John Ewer Road as it is shown on a Plan of Land recorded at <br /> the Barnstable County Registry of Deeds in Plan Book 408, Page 86. <br /> 3. the owner of 19 John Ewer Road(Map 2, Block 132) shall be obliged to <br /> maintain the easement, by periodic cutting and trimming of brush and tree <br /> limbs to prevent encroachment upon the existing traveled way, as shown on the <br /> aforementioned plan, and by periodic grading or filling of pot holes, if any, <br /> should such holes render the condition of John Ewer Road impassable for <br /> emergency vehicles from Pimlico Pond Road to the driveway access to the <br /> dwelling plus 20 feet past the driveway entrance. <br /> 4. the owner of 19 John Ewer Road (Map 2, Block 132) shall also be required to <br /> maintain that portion of John Ewer Road situated within the boundaries of said <br /> Lot so as to provide safe access to and from Pimlico Pond Road to the <br /> dwelling proposed to be constructed on said lot. <br /> The Decision is referenced by plans of Arrow Engineering dated September 18, <br /> 1985. <br />
