Spohr for a Variance 29 Hamblin Road <br /> Map 120, Block 32 <br /> A Petition was filed on August 18, 1995 by Harry T. Spohr of Mashpee, <br /> Massachusetts for a Variance from Sections 174-31, 174-32 and 174-33 of the Zoning <br /> By-laws for permission to vary the setback requirements and to construct a single family <br /> dwelling on an unpaved road in an R-3 zoning district on property located at 29 Hamblin <br /> Road (Map 120, Block 32) Mashpee, Massachusetts. (Owner of record: Elizabeth B. <br /> Spohr). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on August 25, 1995 and September 1, <br /> 1995, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 13, 1995 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: James E. Regan 111, Kenneth E. <br /> Marsters and Cheryl A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Sections 174-31, <br /> 174-32 and 174-33 of the Mashpee Zoning By-laws. <br /> Attorney Kevin M. Kirrane represented the applicant and presented plans for the <br /> construction of a single family dwelling on a gravel way. He explained that the owner has <br /> permission to locate the septic system on a lot directly across the street since the subject <br /> lot is impacted by wetlands. He reviewed the wetland setback requirements and stated <br /> that the lot was created before zoning. Comments were received from abutters <br /> concerning the location of the house on the lot. <br />
