Warner <br /> V-94-13 <br /> A Petition was filed by Lawrence E. and Catherine E. <br /> Warner of Braintree, Massachusetts for a Variance from <br /> Sections 174-31 of the Zoning By-laws for permission to <br /> vary the lot size, frontage and setback requirements to <br /> allow construction of a new single family dwelling in an <br /> R-3 zoning district on property located at 78 Clover Lane <br /> (Map 117 , Block 125 ) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with <br /> .Massachusetts General Laws Chapter 40A. Notice was given <br /> by publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on January 25, 1994 and <br /> February 1 , 1994 , a copy of which is attached hereto and <br /> made a part hereof . <br /> A Public Hearing was held on the Petition on <br /> Wednesday, February 9 , 1994 at 7 : 30 P .M. at the Mashpee <br /> Town Hall at which time the following members of the Board <br /> of Appeals were present and acting throughout : Michael A. <br /> Makunas , Edward M. Govoni and Jamie Regan. _ <br /> Attorney Kevin Kirrane represented the applicant and <br /> informed the Board that the subject lot has been taxed as a <br /> buildable lot since it was purchased and was part of a <br /> recorded plan . He explained that the lot was larger than <br /> most of the developed lots in the immediate area and that <br /> the owner wished to build a single family dwelling. The <br /> Board was informed that the vacant lot had been used for <br /> parking by residents in the area and abutted a developed <br /> lot owned by the applicant . The parcel can accomodate a <br /> septic system and public water is now available. <br />
