Board of Appeals Henry D. and Lisa M. Demers V-94-17 2 .
The Board of Appeals made the following findings:
1 . the topography of the lot with the area of wetland
is an unusual one in the subdivision
2 . the proposed location is the only place on the lot
where a home could be constructed to maximize the
distance from the wetland
3 . the proposed location would encroach only 10 feet
on the front yard setback and conforms to all
other setback requirements and is consistent with
the setbacks of neighboring properties .
The Board determined that, owing to the unique
topography of the lot, a literal enforcement of the front
yard setback requirements of the by-law would involve
substantial financial hardship to the petitioner and that
the front yard setback may be reduced to 30 feet without
substantially derogating from the intent of the by-law and
without substantial detriment to the public good.
Upon motion duly made and seconded the Board of
Appeals voted unanimously on March 9, 1994 to grant the
Variance of 10 feet allowing for a 30 foot front setback.
The Variance is referenced by plans of New Seabury
Engineering ated January 18 , 1994 .
4
= - 3
`.`` c am E 3 ° n om 652 .
V1 D Q O ?u3 ¢apo° ..9 = m? c° ° E=3 O= 02 I
aZ6yF 41§ V_m vl
< T ny0 oO<'L 'J n39S9-. 413
_E
3
g=
e +>• c 3 u E E
` ° m of uLgejLo = °itin a`
