Hendler for a Special Permit <br /> SP-94-19 <br /> A Petition was filed by Robert C. and Auta P . <br /> Hendler of Goshen, . New York for a Special Permit under <br /> Section 174-25 . 1 . 9 of the Zoning By-laws for permission <br /> to construct a pier, ramp and float in Popponesset Creek <br /> in an R-3 zoning district on property located at 156 <br /> Popponesset island Road (Map 112 , Block 12 ) Mashpee, <br /> Massachusetts . <br /> Notice was duly given to abutters in accordance <br /> with Massachusetts General Laws Chapter 40A. Notice was <br /> given by publication in The Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee on February <br /> 18 and February 25, 1994, a copy of which is attached <br /> hereto and made a part hereof . <br /> i A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, March 9 ,1994 at 7 :30 <br /> P .M. at which time the following members of the Board of <br /> Appeals were present and acting throughout : Michael A. <br /> Makunas, Edward M. Govoni and Cheryl A. Hawver. <br /> Attorney Kevin M. Kirrane represented the <br /> applicants and informed the Board that the applicants <br /> had revised plans for a seasonal ramp and float and <br /> fixed pier after consultation with the Shellfish Warden <br /> and the Harbormaster . He explained that the pier had <br /> been lifted 5 ' off the ground to facilitate pedestrian <br /> movement beneath the pier and that the. Conservation <br /> Commission has approved the revised design. He informed <br /> the Board that the dock would be used for a 17 ' Boston <br /> Whaler . Comments were received from the Waterways <br /> Commission in opposition to the permit . <br />
