The Waterways Division of the Commonwealth of <br /> Massachusetts has established minimum <br /> requirements relating to ensuring the <br /> continued free access over navigable waters <br /> and permits an intrusion into a navigable <br /> channel of up to a maximum of 25% of the width <br /> of that channel . The Hendler float will <br /> intrude to a degree of less than 10% of the <br /> width of the Popponesset Creek channel. <br /> In view of the foregoing, the Mashpee Board of <br /> Appeals found that the applicant met the criteria <br /> necessary for the granting of a Special Permit. Upon <br /> motion duly made and seconded the Board of Appeals voted <br /> unanimously on April 13, 1994 to grant the Special <br /> Permit with the following condition: <br /> The boat using the pier shall be limited to a <br /> vessel not to exceed 17 feet and docking shall be <br /> limited to the outer edge of the float . <br /> The Permit is referenced by plans of Eagle <br /> Surveying dated January 12, 1994 and revised February <br /> 17 , 1994 . <br />
