Nichols for a Special Permit SP-94-40 <br /> A Petition was filed by Barbara Nichols of Orono , Maine <br /> for a Special Permit under Section 174-17 to allow a <br /> pre-existing non-conforming seasonal cottage to be rebuilt and <br /> upgraded in an R-5 zoning district on property located at 59 <br /> Jones Road (Map 21 , Block 1 ) Mashpee, Massachusetts . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given 'by <br /> publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on May 6 and May 13 , 1994, <br /> . ;a copy of which is attached hereto and made a .part, hereof . <br /> A Public Hearing was held on the Petition at the Mashpee <br /> Town Hall on Wednesday, May 25, 1994 at 7 : 30 P.M. at which <br /> time the following members of the Board of Appeals were <br /> present and acting throughout : Edward M. Govoni . James E. <br /> Regan III and John J . Friel . <br /> Attorney Michael Ford represented the applicant and <br /> presented plans for the reconstruction of a seasonal cottage . <br /> He informed the Board there there were three houses on the <br /> 5 . 40 acre lot which were built prior to both zoning and <br /> subdivision control . He explained that Section 174-12 of the <br /> Mashpee Code states that there shall not be more than one <br /> principal building on any residential lot but this was enacted <br /> 40 years after the properties existed on the lot . <br />
