Board of Appeals Barbara Nichols - SP-94-40 2 . <br /> The Board of Appeals made the following findings : <br /> 1 : The proposed rebuilding of the cottage identified as <br /> 59A on the plans would conform to all applicable <br /> zoning requirements except the continued existence of <br /> more than one principal dwelling on a lot . <br /> 2 . The change to the dwelling and the upgrading of the <br /> current cesspools represent a substantial improvement <br /> to the neighborhood. <br /> 3 . There are no new non-conformities created by the <br /> proposed new year-round house and no intensification <br /> of the non-conformity. The property is non-conforming <br /> as a result of three residential structures on one <br /> lot . <br /> The Board found that the proposed expansion would not <br /> be a detriment to the neighborhood and that the proposed <br /> reconstruction, its location on the lot, and the intended use <br /> of the structure comply with the general provisions set forth . , <br /> within the By-laws . <br /> Upon motion duly made and seconded the Board of Appeals <br /> voted unanimously on May 25, 1994 to grant the Special Permit . <br /> The Permit is referenced by plans of Baxter and Nye, Inc . <br /> dated May 11 , 1994 . <br />
