Continued from Jan. 3 <br /> R <br /> I <br /> Chairman Ferragamo opened the hearing and Mr . Coffey stepped down <br /> from the hearing and left the room. <br /> IN <br /> All, <br /> John Renz represented the applicant. Chairman Ferragamo said the <br /> Board received a letter from Consulting Engineer Charles Rowley <br /> il <br /> addressing the concerns on the drainage. In his letter Mr. N : <br /> Rowley stated he and the engineer had come to an agreement and <br /> stated revisions that Would have to be made. He also said <br /> revised plan of the pretest concrete basis detail is all that' s <br /> needed. <br /> There were no further comments from the Board or the public. <br /> Chairman Ferragamo noted that the Board could not vote on the <br /> plan at this time as 4 members are needed to vote on a special J­ <br /> permit and there were only 3 member present . <br /> MOTION made by Mr . Bal zarini and SECONDED by Ms. <br /> Mei.jering to close the public meeting was SO VOTED. Fudala announced that the property is in tax title in the <br /> amount of $6, 460. 97 and the Town' s bylaw states no permits may be <br /> issued in such a situation. He said the applicant is not the <br /> owner but a Purchase & Sales Agreement has been signed by the <br /> Almeida's to Fidelity Financial . The engineer said Fidelity <br /> Financial will be holding the property as collateral for funding <br /> services and he had a letter to that effect . <br /> The Board agreed the plan met the frontage requirements, but they <br /> Couldn' t attest to buildability as the building setback was <br /> questionable. <br /> MOTION made by Mr . Coffey and SECONDED by Mr. Balzarini <br /> and SO VOTED to endorse the ANIR Plan. <br /> 0 <br /> T <br />
