MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 8,2021 <br /> Mr. Furbush said that the Board certainly listens to Town Counsel and Building Officials <br /> comments, and is the position that he takes. He asked for a motion in the affirmative, and <br /> then the Board will vote "yes"to overturn, or"no"to uphold the Building Official. <br /> Ron made a motion that the Board approve the Appeal by One Village Market Place LLC <br /> of the Building Official's Design under M.G.L. Chapter 40A §§8 and 15. Applicant <br /> maintains that the lot qualifies as a protected non-conforming buildable single family lot <br /> and should be entitled to a building permit on property located in an R-3 Zoning District, <br /> Map 70 Parcel 165, Mashpee, MA. Mr. Gould seconded. Mr. Furbush did a roll call vote. <br /> Mr. Bonvie voted no, Mr. Goldstein, no, Mr. Gould, no, Mr. Ganzenmuller, no, and Mr. <br /> Furbush,no. The Board voted unanimously to uphold the Building Official's Decision. <br /> NEW HEARINGS <br /> Sitting on this hearing are the four regular Board members and Charlie Reidy. <br /> 374 Monomosco r Road: Petitioner,Roger Brooks,with Capewide Construction requests <br /> a Written Finding under§174-17 of the Zoning Bylaws to allow for an extension,alteration <br /> of a pre-existing non-conforming structure on property located in an R-3 Zoning District, <br /> Map 125 Parcel 17, Mashpee, MA(Owner of Record: Richard J. Moreau, Sr., Trustee). <br /> Mr. Brooks represented the application for a Written Finding. The Board was provided a <br /> site plan and building plans relative to a minor addition on a modest home that is located <br /> on a long and narrow lot. The project includes an extension of the house about 10 ft.toward <br /> the water, and about 20 ft. of new deck also toward the water. The project will maintain <br /> the existing side setbacks which is the non-conformity. The existing lot coverage is 11.4%, <br /> and the proposed is 13.1% which is well under the 20% lot coverage. The project was <br /> approved with an RDA by the Conservation Commission, and is not crossing the 100 ft. <br /> buffer. The project will be built under the flood zone standards. <br /> Dave Morris, Building Commissioner said that the project is very straight forward, and is <br /> a pre-existing situation. He has no issues and will let the Board decide. <br /> Mr. Bonvie wanted to confirm that a negative determination was given by Concom. Mr. <br /> Brooks said; yes. The project is 200 sq. ft. of a family room addition extending the living <br /> room. <br /> Mr. Reidy read the Conservation comment into the record. <br /> There were no more comments from the Board or audience. <br /> 2 <br />
