McInnes Doc.: 1.223806 <br />17 Waterway Ctf.: 200637 <br />(Map 105 Parcel 194) <br />Mashpee, MA 02649 <br />A Petition was filed on September 17, 2021 by Owner, Jeffrey M. McInnes requesting <br />Variance relief from lot coverage under §174-33 (Setbacks from water and wetlands) of <br />the Zoning Bylaws to allow for construction of a detached garage on property located in <br />an R-3 Zoning District, at 17 Waterway, Map 105 Parcel 194, Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br />40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br />circulation in the Town of Mashpee, on October 1, 2021 and October 8, 2021 a copy of <br />which is attached hereto and made a part hereof. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br />Massachusetts General Laws Chapter 40A § 10 and the Town of Mashpee Zoning By-laws. <br />Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br />November 10, 2021 at which time the following members of the Board of Appeals were <br />present and acting throughout; Chairman, Jonathan Furbush, Vice Chairman, William <br />Blaisdell, Board Members, Scott Goldstein and Norman J. Gould, and Associate Member, <br />Brad Pittsley. <br />Mr. Steve Cook, Cotuit Bay Design represented the application. The project includes a one <br />car detached garage with a guest suite above in the rear of the property. The property is <br />bound by three streets, which is Waterway in the front, The Jib on the East, and Daniel's <br />Island Road on the West. The location of the structure will be in the rear of the property <br />and meets all setback requirements. The existing lot coverage is currently 12.8% and the <br />new structure will increase the lot coverage to 18.6%. The homeowner removed a pool that <br />was located in the backyard. <br />Steve said that he was advised by the Building Commissioner to apply with the Board <br />under Section 174-33 for setbacks from wetlands. He said that the entire property is in a <br />flood zone. The site plan depicts Popponesset Creek as 108 ft. away from the proposed <br />structure. The flood zone goes through the existing house. There is an NOI filing with the <br />Conservation Commission which is scheduled for November 17t". He mentioned that the <br />comments from the Board of Health required a sketch of the existing house and number of <br />bedrooms to match with the septic system. <br />
