MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A VARIANCE <br />Owner, Jeffrey M. McInnes <br />17 Waterway (Map 105 Parcel 194) <br />Mashpee, MA 02649 <br />V-2021-59 <br />GENERAL CRITERIA <br />The Board read the Conservation Comments into the record stating that this project will be <br />presented at their next meeting in November. The Board of Health Comments were read <br />into the record and are noted as follows; "A floor plan of the existing dwelling is required <br />to determine existing bedroom count for Title V purposes. A septic inspection is required <br />as more land is being taken up by the proposed garage." <br />There were no more comments from the Board. There were no abutters present. <br />VARIANCE CRITERIA <br />§ 174-33 — Setback from water and wetlands: Any building or structure, exclusive of fixed <br />or floating piers, wharves, docks, bridges or boardwalks, shall be set back at least (50') feet <br />from any water or wetland as defined by MGL C. 131, §40. <br />VARIANCE FINDINGS <br />The Board had a discussion regarding the request for relief from lot coverage. They <br />determined that there is no need for relief from lot coverage because the proposed lot <br />coverage is under the 20% requirement. <br />In view of the foregoing, the Board determined the Petitioner met the criteria for a <br />Variance. Upon motion duly made and seconded at the Public Hearings on Wednesday, <br />November 10, 2021 the Zoning Board of Appeals voted unanimously to issue a 9.3 ft. <br />Variance. The Board accepted the withdrawal for relief from lot coverage because it was a <br />clerical error. The Board motioned to approve 17 Waterway, to Owner, Jeffrey M. McInnes <br />for request of setback relief from wetlands with the following conditions; <br />1. The Board has determined that the applicant meets all the conditions of a Variance <br />under Mass General Law 40A Section 10. <br />2.
