MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A SPECIAL PERMIT <br />Petitioner, Chris Childs, Patriot Builders <br />Owner of Record: Christopher M. DeSantis and Laurie A. Stucchi <br />14 Pine Avenue (Map 123 Parcel 40) <br />Mashpee, MA 02649 <br />The site plan depicts the proposed addition in the Southeast corner will square off the <br />existing building. The rectangle to the left on the plan is a proposed deck. The original deck <br />is being removed. On the bottom right corner is an existing covered porch and will be part <br />of the living space with a new foundation. A stoop that is 40 sq. ft. will be added but does <br />not require setbacks and is flush with the ground. <br />Mr. Furbush questioned the cantilevers on the south side of the proposed building. The site <br />plan shows a bumped out bay window. Mr. Lizardi-Rivera prepared the plans for the <br />project. He said that the existing house extends a few inches at the foundation that is part <br />of the corner boards and siding. <br />Dave asked if the bulkhead will be removed. Mr. Childs said that the bulkhead is being <br />replaced with an emergency escape well. The deck does not have a roof. Dave requested <br />an engineer provide his stamp on the foundation as -built to confirm the integrity of the <br />foundation. <br />Sharon read the Board of Health comments dated November 9, 2021, and Conservation <br />comments into the record. <br />Chris Gallagher, Town Engineer mentioned that the dimensions were missing on the house <br />plan, and thought that the height might exceed the 35 ft., but the average elevation is 21.5 <br />ft. The allowed height above the foundation would be 33.5 ft. He recommended that the <br />plan not be approved until the Building Commissioner approves the actual plan depicting <br />the actual height of the building. The top of the roof cannot be 33.5 ft. above the existing <br />foundation. <br />GENERAL CRITERIA <br />The subject property located at14 Pine Avenue is approximately 8,000 square feet. <br />There were no abutters present. <br />SPECIAL PERMIT CRITERIA <br />ARTICLE V - Nonconforming Buildings and Uses <br />§174-17.1 Raze and Replace History: Added 10-15-2018 ATM, Article 16, approved by <br />Attorney General 1-9-2019. <br />2 <br />
