MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Laurie Mancinelli and Joseph Mancinelli <br /> 18 Wilsons Grove (Map 118 Parcel 72) <br /> Mashpee, MA 02649 <br /> SP-2022-06 <br /> He said that nothing that is proposed onsite in terms of elevation, or grading is going to <br /> impact the inability of the abutter to park on their own property, and will confirm this with <br /> Brian Foley, Project Manager. He provided the Board with photos that confirm that most <br /> of the dwellings in that neighborhood were replaced with two story structures. He said that <br /> his client would be willing to plant a row of arborvitae or if the abutters prefer a fence <br /> could be installed between the two properties. <br /> Mr. Foley confirmed that the new dwelling height is 29 ft. 6 inches. Attorney Kirrane said <br /> that the average natural grade is 29 ft. 6 inches, but the plans show what the elevations <br /> were above sea level. <br /> GENERAL CRITERIA <br /> The subject property located at 18 Wilsons Grove is approximately 3,600 square feet. <br /> There were abutters present who spoke of their concerns regarding the height of the <br /> proposed dwelling, bedroom count,and parking concerns. These concerns were addressed <br /> by the Attorney. There were no more comments from the Board. <br /> SPECIAL PERMIT CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses <br /> §174-17.1 Raze and Replace History: Added 10-15-2018 ATM, Article 16, approved by <br /> Attorney General 1-9-2019. <br /> No pre-existing,non-conforming single or two (2) family dwelling structures shall be torn <br /> down and rebuilt on any lot unless there is an issuance of a Special Permit from the Zoning <br /> Board of Appeals. Such a Special Permit may be granted only if the Zoning Board of <br /> Appeals finds that any changes,extensions,alterations or reconstruction of the pre-existing <br /> non-conformities are not substantially more detrimental than exists prior to removal of the <br /> existing structure and that there is adequate land area to provide sufficient parking. In no <br /> case shall new non-conformities be permitted without the issuance of a Variance. <br /> SPECIAL PERMIT FINDINGS <br /> The Board determined the following; <br /> • The height of the proposed dwelling was corrected on the site plan. <br /> • The bedroom count was confirmed by the Board of Health. <br /> • Any storm water drainage will be contained onsite. <br /> 3 <br />
