MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
FEBRUARY 23,2022
The Building Inspector had raised a couple of issues which the Attorney does not recall,
but believes those issues were addressed. There were concerns raised on the height of the
building, but a "stop work order" was never issued on the building, and after the
construction of the frame, the building was completed.
Attorney Kirrane provided photographs of the building that has several roof lines based
upon dormers that run front to back on the entire structure. There is also a widow's walk.
Attorney Kirrane understands the Board's concerns relative to height relief and he
explained that to the contractor. There's a problem that the building exceeds the height
restriction by 1.8 ft. and the remedy would be the removal of the roof or to seek Variance
relief from the Board. Attorney Kirrane does not cast any blame on anyone, but it would
have been better if a stop work order had been issued.Attorney Kirrane said that a mounted
septic system was installed because that area has an unusually high water table. When the
mounted system was installed the grades on that lot may have changed, and that may have
contributed to the issue due to the building height. He asked the Board to allow the building
to remain rather than to dissemble the complex roof structure.
Mr. Furbush said that comments have been submitted by any departments. He asked the
Board if they had any comments before reading those department comments.
Mr. Gould said that the Board has been very careful to inforce the height limit, but not
enforcing the proper height now, especially with the previous petitioner, would be
rightfully disappointed.
Mr. Furbush read an email dated June 29, 2021 from Chris Gallaher, Town Engineer to
Dave Morris referencing the subject property® He also read two emails dated February 17,
2022 from the To Engineer.
Mr. Furbush also read a letter submitted by Weller & Associates dated August 29, 2019,
and a letter dated March 15, 2021 signed by Steven W. Rumba, Professional Land
Surveyor. He read a letter dated February 17, 2022 from David Morris, Building
Commissioner, and an email dated February 17, 2022 from Evan Lehrer, To Planner.
Mr, Dennis Balzarini, an abutter spoke and is in opposition of the variance request,
Mr. Blaisdell noticed that a letter dated March 26, 2020 from Weller & Associates was
submitted, and said the same as the letter dated March 15, 2021.
10
