MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY 23, 2022 <br /> Mr. Morris said he reached out to Chris Weller, Engineer of Weller & Associates. Mr. <br /> Morris emailed him on May 27, 2021 requesting a letter explaining the 3 ft. contradiction <br /> in the letters dated 8/29/19, and 5/15/2021. Mr. Morris never received an answer or a letter <br /> response. <br /> Mr. Blaisdell asked if the letters that were sent and stamped by the Engineer was giving <br /> the wrong information. Attorney Kirrane said; yes that is correct. <br /> Attorney Kirrane said he hired an engineer to measure the building, and it was 1.8 ft. He <br /> commented that the building height change occurred during construction of the building. <br /> He doesn't know if the design of the building was changed from the original plans. He said <br /> that if an error was determined at the time of construction, a stop work order could have <br /> been issued at that time. <br /> Mr. Furbush asked what the process is for inspections to be performed, and if it is up to the <br /> builder to make sure those inspections are performed correctly. <br /> There was discussion regarding the inspections done on the site. Mr. Bonvie said that in <br /> his opinion there was an error made by the engineer. There was no more discussion from <br /> the Board or audience. <br /> Mr. Bonvie said that he will make a motion in the affirmative, and the Board can decide <br /> how to vote. <br /> Mr. Bonvie motioned that the Board issue a Variance in the amount of 1.8 ft. to Stewart <br /> M.Dobson and Barbara A. Dobson under §174-31 of the Zoning Bylaws to vary the height <br /> of a single family residence on property located in an R-3 Zoning District, Map 125 Parcel <br /> 140, Mashpee, MA. <br /> Mr. Gould seconded. Mr. Gould voted no, Mr. Blaisdell, no, Mr. Pittsley, no, Mr. Bonvie, <br /> no, and Mr. Furbush, no. The Board voted unanimously to deny the Variance request. <br /> OTHER BUSINESS <br /> 29/41 Echo Rd: M3 Ventures, Inc.d/b/a Triple M request a Modification to (SP-2015-33, <br /> 2019-36, and 2020-28). The proposed building footprint will be reduced from 3,700 sq. ft. <br /> to 3,600 sq. ft. to a single story, and will be aesthetically more keeping with the Cape Cod <br /> architecture. <br /> Attorney Kevin Kirrane is representing the application for a very simple request. Also <br /> present were Lianne Anker, and Kevin O'Reilly, Principals of Triple M who operate the <br /> marijuana facility on Echo Road. <br /> 11 <br />
