Smith SP-94-54 <br /> A Petition was filed by Thomas F. and Bonnie A. Smith <br /> of Cotuit , Massachusetts for a Special Permit under Section <br /> 174-25 .H.7 of the Zoning Sy-laws to allow the construction <br /> of a two-car garage as a principal use on property located <br /> in an R-3 zoning district at 266 Monomoscoy Road (Map 120 , <br /> Block 57B) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given <br /> by publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on July 8 and July 15 , <br /> 1994, a copy of which is attached hereto and made a part <br /> hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, July 27 , 1994 at which time <br /> the following members of the Board of Appeals were present <br /> and acting throughout: Edward M. Govoni, Kenneth E. <br /> Marsters and Robert G. Nelson. <br /> Mr . Smith informed the Board that his lot could not be <br /> used for a residence but with the passage of 174-25 .H. 7 <br /> could be used for accessory use. He presented plans for a <br /> 26 ' x 28 ' garage which exceeded the height restriction of <br /> 15 ' in the by-law. Mr. Smith was informed that he would <br /> have to apply for a Variance to exceed the height <br /> restriction or reduce the height of the building. He was <br /> also asked for framing plans for the building inspector. <br /> At the October 12 , 1994 meeting of the Board, Mr . <br /> Smith agreed to revise plans to conform to the height <br /> restrictions . <br /> a. Findings: <br /> 1 . the subject property is located at 266 Monomoscoy <br /> Road and contains 10, 500 square feet . <br /> 2 . the subject property is located in an R-3 <br /> residential zoning district. <br /> 3 . the immediate neighborhood consists of single <br /> family homes . <br />
