Hendler for a Special Permit <br /> SP-94-59 <br /> A Petition was filed by Robert C. and Auta P . Hendler of <br /> Goshen, New York for a Special Permit under Section 174-17 for <br /> permission to remove an existing non-conforming residential <br /> dwelling and replace it with a new residential dwelling on <br /> property located in an R-3 zoning district at 156 Popponesset <br /> Island Road (Map 112 , Block 12 ) Mashpee, Massachusetts . . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee , on July 12 and July 19 , <br /> 1994 , a copy of which is attached hereto and made a part <br /> hereof . <br /> A Public Hearing was held on the Petition at the Mashpee <br /> Town Hall on Wednesday, July 27 , 1994 at 7 : 30 P .M. at which <br /> time the following members of the Board of Appeals were <br /> present and acting throughout : Edward M. Govoni . Cheryl A. <br /> Hawver and Kenneth E. Marsters . <br /> Attorney Kevin Kirrane represented the applicants and <br /> presented plans for the replacement of a non-conforming <br /> dwelling . He explained that the current residential structure <br /> does not have a foundation which conforms to current flood <br /> plain construction requirements . <br />
