Yurek for a Special Permit <br /> SP-94-61 <br /> A Petition was filed by Gregory J . and Carol L. Yurek <br /> of Wellesley, Massachusetts for a Special Permit under <br /> Sections 174-17 and 174-63 of the Zoning By-laws to allow <br /> the replacement of an existing non-conforming dwelling with <br /> a new single family dwelling on property located in an R-3 <br /> zoning district at 199 Daniel ' s Island Road (Map 100 , Block <br /> 35 ) Mashpee, Massachusetts . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise , a newspaper of general <br /> circulation in the Town of Mashpee, on August 5 and August <br /> 12 1994 , a copy of which is attached hereto and made a part <br /> hereof . <br /> A Public Hearing was held on the Petition at the <br /> Msshpee Town Hall on Wednesday, August 24 , 1994 at 7 : 30 P .M. <br /> at which time the following members of the Board of Appeals <br /> were present and acting throughout : Edward M. Govoni, James <br /> E . Regan III and John J . Friel . <br /> Engineer Michael H. Grotzke represented the applicants <br /> and informed the Board that the applicants plan to replace a <br /> 40-year old dwelling with a new single family dwelling. He <br /> explained that the existing dwelling is structurally unsound <br /> and the Building Inspector recommended that it be removed <br /> to allow reconstruction of the foundation and a new <br /> dwelling. The applicant also proposes to add a garage and <br /> swimming pool and remove an existing shed. Mr . Grotzke <br /> explained that part of the structure is located in the flood <br /> plain and it is proposed to raise the structure <br /> approximately 3 feet. <br /> Comments were received from an abutter who questioned <br /> the location of the house on the lot . Mr . Grotzke explained <br /> that the house was sited on the footprint of the original <br /> dwelling and had been approved by both the Conservation <br /> Commission and the Board of Health. <br />
