Board of Appeals Lillian B . Shubow V-94-69 2 . <br /> The Board of Appeals made the following findings : <br /> 1 . the undeveloped lot contains 1 .93 acres and it is <br /> surrounded by lots of similar size which have been <br /> developed with single family dwellings . <br /> 2 . the unpaved Crescent Road is accessible to <br /> vehicular traffic and is typical of many unpaved <br /> roads in the Town. <br /> 3 . other than a building lot, said lot could be put <br /> to no other profitable use . <br /> On the basis of these factors , the Board determined <br /> that a literal enforcement of the By-law would involve <br /> substantial financial hardship to the Petitioner and that <br /> desirable relief could be granted without nullifying from <br /> the intent or purpose of the zoning By-law and without <br /> detriment to the public good . <br /> Upon motion duly made and seconded the Board of <br /> Appeals voted unanimously on September 28 , 1994 to grant <br /> the Variance . <br /> The Variance is referenced by a topographic plan of <br /> Cape and Islands Engineering 092494 dated September 24 , <br /> 1994 . <br />
