MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE : Henry J . and Susan Cartland-Bode SP-94-71 <br /> A Petition was filed by Henry J . and Susan Cartland-Bode <br /> of Oak Park, Illinois for a Special Permit under Section <br /> 174-17 for permission to raze a pre-existing non-conforming <br /> dwelling and replace it with a new single family dwelling. <br /> The proposal includes the combination of lots to include <br /> vacant land located in an R-3 zoning district at 26 Bayview <br /> Road ( Map 119 , Blocks 41 and 44 ) Mashpee , Massachusetts . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise , a newspaper of general <br /> circulation in the Town of Mashpee , on September 9 and <br /> September 16 , 1994 , a copy of which is attached hereto and <br /> made a part hereof . <br /> A Public Hearing was held on the Petition at the Mashpee <br /> Town Hall on Wednesday, September 28 , 1994 at 7 : 30 P .M. at <br /> which time the following members of the Board of Appeals were <br /> present and acting throughout : Edward M. Govoni . James E. <br /> Regan III and Kenneth E . Marsters . <br /> Barbara Frappier of Wm. M. Warwick Engineers represented <br /> the applicant and presented plans for the replacement of an <br /> existing non-conforming dwelling and the combination of two <br /> lots . The Board was informed that the Conservation Commission <br /> has approved plans pending receipt of a landscaping plan. The <br /> proposal includes an upgrade of the existing septic system. <br />
