Board of Appeals Robert L. and Eileen M. Gauthier 2 . <br /> Findings : <br /> 1 . the subject property is located at 12 Metacomet <br /> Road and contains 13 , 340 square feet and 127 . 04 feet of <br /> frontage on Matacomet and Manitoba Sts . The property is in <br /> an R-3 zoning district which requires 40 , 000 square foot lot <br /> size and 150 feet frontage. <br /> 2 . the subject property is shown on the South Cape <br /> Beach Subdivision Plan 26502B filed in the Land Court on <br /> October 6 , 1969 . The subdivision was in an R-100 zoning <br /> district which required lot size of 10 , 000 square feet and <br /> frontage of 100 feet. <br /> 3 . the subject property was purchased from the Great <br /> River Corporation on May 10 , 1972 . <br /> 4 . the lot has been separately maintained and <br /> assessed as a buildable lot since 1972 . The current assessed <br /> value of the lot is $58 , 300 . The lot has been improved with <br /> Town water and is subject to a projected betterment charge <br /> of $4 , 597 . 00 . <br /> 5 . Prior to May 7 , 1990 , Mashpee Zoning provided that <br /> where two or three adjoining non-conforming lots were held <br /> in common ownership on Feburary 11 , 1985,. or at the time <br /> they became non-conforming, whichever is later, one <br /> single-family residential building and its permitted <br /> accessory buildings and improvements could be built on such <br /> lots , provided that the lot contained at least ten thousand <br /> ( 10 , 000 ) square feet and seventy-five ( 75 ) feet of frontage . <br /> R ( Section 5 .5 ) . <br /> 6 . Section 5 . 5 was replaced with Section 174-21 at <br /> the Town Meeting of May 7 , 1990 . Section 174-21 states that <br /> nonconforming lots may be developed as allowed by MGL C . 40A <br /> Section 6 ,. as amended. <br />
