• Board of Appeals Minutes - June 23, 1993 5. <br />Joseph J. and Sandra L. Slotnik - Request a Variance from <br />Section 174-31 of the Zoning By-laws for permission to vary <br />the minimum lot size and frontage requirements in an R-5 <br />zoning district on property located at 718 Cotuit Road (Map <br />7, Block 2) Mashpee, MA. <br />Members sitting: J. Friel, M. Makunas, E. Govoni <br />Attorney Robert Mills represented the applicants and informed <br />the Board that the owners owned 3 lots on Cotuit Road, and <br />one had 2 houses on one lot. They proposed a change of lot <br />lines to allow for single houses on Lot 1 and Lot 2. The <br />result would be Lot 1 at 75,411 sf and Lot 2 at 25,361 sf. <br />The Board noted that a garage on Lot 1.encroached on the <br />property line into the road. There was discussion of the ANR <br />from the Planning Board and Mr. Makunas questioned if <br />variances were necessary since lots predated zoning. <br />Mr. Friel moved to grant a Variance for Lot 1 allowing a lot <br />size of 75.411 sf' and the existing garage would have zero <br />• setback from the property line. The lot size variance is <br />4,589 sf. and the front setback variance is 40'. He moved to <br />grant the Variance for Lot 2 allowing a lot size of 25,361 sf' <br />and a frontage of 109.96. The lot size variance is 54,639 sf <br />and the lot frontage variance would be 40.04!. Mr. Govoni <br />seconded. All agreed. <br />New Seabury Nominee Trust - The Board received a written <br />request from Attorney Mark Gildea to withdraw an appeal of <br />the Building Inspector's decision. Mr. Friel moved to accept <br />the request for withdrawal. Mr. Govoni seconded. All <br />agreed. <br />Meetings - Mr. Friel explained that a June 30, 1993 meeting <br />was necessary. He asked members to submit suggestions for <br />revisions in the by-laws. <br />Mr. Regan moved to adjourn at 9:45 P.M. Mr. Govoni seconded. <br />All agreed. <br />Elinor Walsh <br />• <br />
