• Board of Appeals Minutes - June 23, 1993 4. <br />• <br />Richard M. Cushner - Requests a Special Permit under Section <br />174-17 of the Zoning By-laws for modifications to an existing <br />dock in Great River in an R-3 zoning district on property <br />located at 22 Samoset Road (Map 125, Block 65) Mashpee, MA. <br />(Owners of record: Richard M. and Estelle G. Cushner). <br />Richard M. Cushner - Requests a Variance from Section <br />174-25.I.9 of the Zoning By-laws for permission to exceed the <br />70' dock length to allow a 126' length in an R-3 zoning <br />district on property located at 22 Samoset Road (Map 125, <br />Block 65) Mashpee, MA. (Owners of record: Richard M. and <br />Estelle G. Cushner). <br />Members sitting: J. Friel, M. Makunas, E. Govoni <br />Attorney Kevin Kirrane represented the applicant and <br />explained that the Conservation Commission had asked for a <br />new design for a dock which had been permitted earlier. No <br />comments were received from abutters. <br />Mr. Makunas moved to grant the Variance of 56' to allow for a <br />length of 126'. Mr. Friel seconded. All agreed. <br />Mr. Makunas moved to•grant the Special Permit. Mr. Govoni <br />seconded. All agreed. <br />G.E. Capital Mortgage Services Inc.- Requests a Variance from <br />Section 174-31 of the Zoning By-laws for permission to vary <br />the sideline setback requirements in an R-5 zoning district <br />on property located at 111 River Road (Map 89, Block 3) <br />Mashpee, MA. (Owner of record: John J. Shaughnessy). <br />Members sitting: J. Friel, M. Makunas, E. Govoni <br />Attorney Mark Lanza represented the applicant and explained <br />that the property had been foreclosed and resold and that a <br />condition of the new sale was to clear the title of a <br />violation in side line setbacks. Mr. Makunas explained that <br />the Variance was not necessary technically since the codes <br />allowed a 4' encroachment on setbacks for egress. Mr. Lanza <br />explained that the Mashpee By-laws do not clarify this <br />permitted use. <br />Mr. Makunas moved to grant a Variance of 1.3' on the <br />Southerly side. Mr. Govoni seconded. All agreed. <br />
