1 <br />0 <br />Board of Appeals Minutes - August 25, 1993 2• <br />George J. Devlin - Requests a Special Permit under Section <br />174-17 of the Zoning By-laws for permission to demolish an <br />existing single family non -conforming home and construct a <br />new single family home and garage in an R-3 zoning district <br />on property located at 8 Shore Drive (Map 112, Block 23) <br />Mashpee, MA. <br />Members sitting: J. Friel, M. Makunas, E. Govoni <br />Attorney Quinlan represented his application. He explained <br />that his architect had reviewed the structure he has owned <br />in Popponesset for 33 years and determined that the <br />foundation was not strong enough to take remodeling and <br />suggested removing the structure and rebuilding. He <br />reviewed recent legal opinions on expansion of <br />non -conforming structures. He said he felt that the home <br />would not be more detrimental than the existing home. He <br />explained that he had reviewed plans with all of the <br />abutters and there were no objections. <br />• He said the structure meets the 20% lot coverage and new <br />height requirement. He explained that the bulkhead would <br />be 8' from the lot line. Mr. Govoni explained that the <br />Building Inspector is using the 7 1/2' side line setbacks <br />in that area since the lots predated zoning. Mr.Sanicki <br />presented the subdivision plan which was filed in 1948 <br />before zoning. He said earliest setbacks were 7 1/2' <br />sideline and 20' front. Mr. Makunas explained that when a <br />structure was built on the lot the original zoning rights <br />were lost. Mr. Friel noted that a memo had been received <br />from the Town Planner. <br />Mr. Govoni moved to grant the Special Permit. Mr. Friel <br />seconded. All agreed. <br />Colonial Industries - Requests a Special Permit under <br />Section 174-25.G.5 of the Zoning By-laws to allow for <br />manufacturing, assembly or packaging of goods in an I-1 <br />zoning district on property located at 92 Industrial Drive <br />(Map 88, Block 32) Mashpee, MA. (Owner of record: George <br />H. Twomey). <br />Members sitting: J. Friel, M. Makunas, E. Govoni <br />• James Curtis of Colonial Industries represented the <br />Petition and explained that his business does assembly of <br />first-aid kits and is planning to become a non-profit <br />agency. He explained that there would be no hazardous <br />.waste. He anticipates 30 employees eventually. <br />Mr. GOvoni moved to grant the Special Permit. Mr. Makunas <br />seconded. All agreed. <br />
