0 <br />Board of Appeals Minutes - August 25, 1993 3• <br />Robert J. Gabriel TR. Requests a Variance from Section <br />174-32 of the Zoning By-laws to allow for construction of a <br />single family residence on a roadway of permeable material <br />in an R-3 zoning district on properties located at 2 <br />Daniel's island Road (Map 111, Block 23) 4 Wading Place <br />Road (Map 111, Block 24) and 10 Wading Place Road (Map 111, <br />Blocks 25 & 26) Mashpee, MA. <br />Members sitting: J. Friel, M. Makunas, E. Govoni <br />Attorney Mark Gildea represented the applicant and reviewed <br />plans of three lots off of Wading Place Way. Attorney Clark <br />was also present. Mr. Gildea explained that the lots were <br />subject to Orders of Conditions from the Conservation <br />Commission requiring that the driveways and roadway be <br />constructed of permeable material. <br />Comments were received from the Fire Department and <br />Department of Public Works questioning traffic problems. A <br />letter was received from an abutter questioning impact on <br />drainage. Mr. Gildea said Conservation had addressed those <br />issues. Mr. Gildea said the roadway would be 20' with only <br />one entrance. There was discussion of the poor condition <br />of Wading Place Road. <br />Mr. Gildea said they would agree to a "No Left Turn" sign <br />and questioned if some of the abutting lots were buildable <br />without a Variance. Mr. Makunas said the intent of the <br />by-law was to protect people from developers who might not <br />complete construction of a road. He said a Variance for <br />environmental reasons was valid. Mr. Govoni said that if <br />granted the road should be maintained at 20'. Attorney <br />Clark said it could be conveyed with the restriction that <br />it be maintained at 201. <br />Mr. Friel moved to grant the Variances for the three lots <br />with the condition that the driveways shall be.maintained. <br />Mr. Makunas seconded. All agreed. <br />• <br />
