"l <br />Board of Appeals. Minutes - September 22, 1993 3. <br />Louis and Ethelleen Antunes - Request a Variance from Section <br />174-32 of the Zoning By-laws to allow for construction of a <br />single family residence on a roadway of permeable material in <br />an R-3 zoning district on properties located at 10 Antunes <br />Avenue (Map 69, Block 178) and 11 Antunes Avenue (Map 69, <br />Block 179) Mashpee, MA. <br />Members sitting: J. Friel, M. Makunas, C. Hawver <br />Mrs. Antunes explained that the gravel road has been <br />constructed with four drains and that the Planning Board has <br />released the covenant on the road. Mrs. Antunes stated that <br />the road would have to be paved when a third house was built. <br />Mr. Friel said he had received a call from the Fire Chief who <br />is opposed to the application. Chief Baker thought the road <br />might not be passable and there was no water on the street. <br />Mr. Makunas explained that this by-law was designed to protect <br />homeowners from developers who might not complete the work and <br />that fire engines could travel on dirt roads. Mr. Hauck <br />• explained that the road was wide enough for two engines to <br />pass and was constructed according to Town road <br />specifications. <br />Mr. Makunas reviewed the hardship requirements and Mrs Friel <br />explained that the hardships had been imposed by the Town. <br />Selectman Jacobson commented that Chief .Baker had said that if <br />the road is plowable it would not be a problem. Mr. Friel <br />noted that a letter had been received from Chief Baker <br />objecting to the variance. <br />Mr. Makunas moved to grant two variances for Map 69 Block 179 <br />and Map 69 Block 178. Mr. Friel seconded. All agreed. <br />New Applications - There was discussion of applications for <br />the October meeting. Mr. Hauck said he had discussed one <br />application with the Cape Cod Commission and believed it would <br />have to be referred for a Determination if it was a D.R.I. <br />Mr. Friel moved to adjourn at 9:15 P.M.
