')e <br />• Board of Appeals Minutes - September 22, 1993 2. <br />Mr. Friel explained that this is an expansion of a <br />pre-existing non -conforming use and the hearing was not <br />advertised to address the revised plans. He said the site <br />already has substantial use. Mr. Makunas said that the <br />request for the Special Permit was to do business on the <br />existing site and not a request to build a structure on a <br />commercial lot. Ms. Hawver questioned what limited outside <br />display was planned and Mr. Conviser said he planned to have a <br />tent in the picket fence area and display golf clubs and bags. <br />Mr. Conviser said he now only wanted retail sales. <br />Mr. Hauck said the application changed every time he had <br />discussed it and he would recommend that the Plan Review <br />process be used for the whole site. He said the only reason <br />for the Board of Appeals application was for outside sales. <br />Mr. Makunas felt the changes now were not within Board of <br />Appeals jurisdiction. Mr. Friel suggested withdrawal. Mr. <br />Conviser signed a request for withdrawal. <br />Mr. Friel moved to accept the withdrawal without prejudice. <br />Ms. Hawver seconded. All agreed. <br />• James L. Galvin - Request for Variance from Section 174-31 and <br />Special Permit under 174-17 for permission to construct a <br />garage in an R-3 zoning district on property located at 27 <br />Popponesset Island Road (Map 105, Block 263) Mashpee, Ma. <br />Members sitting: J. Friel, M. Makunas, C. Hawver <br />Mr. Friel explained that the Board had received a request for <br />withdrawal of both applications and moved to accept the <br />withdrawals without prejudice. Mr. Makunas seconded. All <br />agreed. <br />William M. and Geraldine H. McCormack - Request a Special <br />Permit under Section 174-25.I.9 of the Zoning By-laws for an <br />extension to an existing pier in Jehu Pond in an R-3 zoning <br />district on property located at 77 Tide Run (Map 120, Block <br />190) Mashpee, MA. <br />Members sitting: J. Friel, M. Makunas, C. Hawver <br />Environmental Scientist Peggy Fantozzi represented the <br />applicant and explained that the Conservation Commission had <br />issued an order of Conditions. She explained that changes in <br />the ramp and float required the present filing. The owners <br />had received and Variance and a Special Permit in 1992. Mr. <br />. Friel moved to grant the Special Permit. Mr. Makunas <br />seconded. All agreed. <br />
