Stanley - Requests a Special Permit under Section <br />174-17 of the zoning By-laws for permission to expand a <br />non -conforming structure in an R-3 zoning district on <br />property located at 70 Uncle Percy's Road (Map 117, Block <br />177) Mashpee, MA. <br />Members sitting: J. Friel, M. Makunas, E. Govoni <br />Engineer John Slavinsky explained that the applicant wants <br />to enclose a 12' x 22' section of the deck as a house <br />addition with no change in lot coverage. Mr. Makunas <br />explained that the changes in the by-law will allow this <br />without special permit. <br />Mr. Makunas moved to grant the Special Permit. Mr. Govoni <br />seconded. All agreed. <br />Barbara and Steven R. Ball - Request a Special Permit under <br />Section 174-17 of the zoning By-laws for permission to <br />expand a non -conforming structure in an R-3 zoning district <br />on property located at 53 Amy Brown Road (Map 109. Block 1) <br />Mashpee, MA. (Owner of record: Richard E. Ball). <br />Members sitting: J. Friel, M. Makunas, E. Govoni <br />Steven Ball represented his Petition. He was informed that <br />the Board had received a legal opinion from Town Counsel <br />stating that any Special Permit had to be conditioned with <br />the Attorney General's approval of the new by-law and that a <br />Building Permit could not be issued until the by-law was <br />approved. The Board reviewed plans for a 20' x 48' dwelling <br />with an attached 20' x 30' garage and 10' x 20' porch. <br />Mr. Makunas moved to grant the Special Permit under 174-17 <br />to expand a non -conforming structure at 53 Amy Brown Road <br />based on the revised drawings of 9/29/93 with the <br />restriction that this Special Permit becomes valid only if <br />the revised 174-31 from the Town Meeting of October 4. 1993 <br />is approved by the Attorney General. Mr. Govoni seconded. <br />All agreed. <br />
