Tho committee also requests that another impartial party =aka the
Ii decision regarding the appeal of the zoning since there appears to be a
conflict of interest. The Committee believes that this conflict would
hinder the judgement of the board. Those conflicts include:
1) Mr. DiMaggio is on the Planning Board.
2) His son. John Doherty. is on the Board of Health.
3) Mr. DiMaggio holds several contracts with the town.
4) The salutation of Mr. Hauck's letter to John Doherty of 8/27/93 implies certain level
of familiarity (i.e. "Dear John." as opposed to "Dear Mr. Doherty:") that raises question
and concern as to the Building Inspectors impartiality.
Some suggested third parties include:
1) The Attorney Generals Office
2) The Land Court of Massachusseas
0
•
As a final note, we urge the Board of Appeals to carefully review this
case. Particularly in light of Mr. DiMaggio's previous attempt to submit
altered documents that falsely designated the property in question as
commercial, when in fact an investigation, by the Building Inspector,
uncovered the fact that it was residentially zoned. This fraudulent act
would have put the Nynex Corporation and the town in jeopardy of a
potential lawsuit.
Thank you for your time and attention in this matter.
The Concerned Citizens Coalition
a
