0 <br />TOWN OF MASHPEE <br />Board of Appeals <br />Minutes <br />Wednesday, December 8, 1993 <br />The Mashpee Board of Appeals held a meeting on Wednesday, <br />December 8, 1993 at 7:30 P.M. at the Mashpee Town Hall. Board <br />Members present and acting throughout were: John J. Friel, <br />Chairman; Michael A. Makunas, Vice-chairman and Jamie Regan, <br />Associate Member. Building Inspector William F. Hauck was in <br />attendance. <br />Leo J. Skaparas - Requests a Special Permit under Section <br />174-25.A.13 of the Zoning By-laws for permission to operate a <br />three bedroom Bed and Breakfast in an R-5 zoning district on <br />property located at 614 Old Barnstable Road (Map 79, Block 68) <br />Mashpee, MA. <br />Members sitting: J. Friel, M. Makunas, J. Regan <br />Mr. Skaparas explained that he planned a three bedroom <br />• <br />addition to his home to be used as a Bed and Breakfast. Mrs. <br />Skaparas noted that they were responsible for the Article on <br />Town Meeting Warrant which allowed this use in a residential <br />district. Mr. Makunas moved to grant the Special Permit <br />subject to the restriction that they operate on a 10 -month <br />season as a Bed and Breakfast. Mr. Friel explained that they <br />would have to have a different permit if they wanted to <br />operate a rooming house. Mr. Friel seconded. All agreed. <br />Thomas W. Brooks Jr. - Requests a Special Permit under <br />Sections 174-17, 174-31, 174-12, 174-32 and 174-25.I.9 of the <br />Zoning By-laws for permission to expand a non -conforming <br />dwelling with a 7.4' x 24' house addition and an 8' x 11' deck <br />and to license an existing dock in an R-5 zoning district on <br />property located at 15 Sturgis Lane (Map 20, Block 27) <br />Mashpee, MA. (Owner of record: Richard C. 8 Daniel M. <br />Desantis). <br />Members sitting: J. Friel, M. Makunas, J. Regan <br />Dr. Brooks explained that his property included two cottages <br />and an existing dock. He stated that one of the houses was in <br />need of repair and he planned to upgrade one cottage and add a <br />deck. There was discussion that Conservation required a dock <br />permit and Mr. Makunas said that the dock should be handled <br />separately with a separate decision. Mr. Hauck noted that the <br />dock permit was required to repair and maintain the existing <br />structure. Mr. Makunas explained that the cottages were built <br />before zoning and were pre-existing, non -conforming <br />structures. <br />
