• Board of Appeals Minutes - December S, 1993 3. <br />Dean Souke, son of a direct abutter, said they were not <br />notified although they are most effected and he felt his <br />mother's property would be devalued by 15%. He said neighbors <br />have tried to adhere to setback lines in the neighborhood and <br />he objects to allowing intensification. D. Young, another <br />abutter, questioned if a fence would prevent trespassing. <br />Mr. Mell said he did not think he was encroaching but he would <br />not pursue it if neighbors object. Mr. Makunas said the Board <br />had to consider if this was more detrimental than the <br />pre-existing use. <br />Mr. Friel moved to deny the application without prejudice. <br />Mr. Regan seconded. All agreed. <br />Mr. Friel called a recess at 8:40 P.M. The Board reconvened <br />at 8:55 P.M. <br />Joseph Carreiro - Requests a Special Permit under Section <br />174-17 of the Zoning By-laws for permission to expand a <br />non -conforming dwelling with a 16' x 22' house addition and an <br />S' x 14' deck in an R-3 zoning district on property located at <br />• 71 Bluff Avenue (Map 118, Block 63) Mashpee, MA. <br />Members sitting: J. Friel, M. Makunas, J. Regan <br />Engineer John Slavinsky represented the applicant and Y <br />explained that the addition of a sunroom would increase the <br />lot coverage but would not encroach on the setbacks. No <br />objections were received from abutters. <br />Mr. Makunas moved to grant the Special Permit. Mr. Regan <br />seconded. All agreed. <br />Discussion <br />E. Thomas Jones - Mr. Jones explained that his attorney had <br />written to his abutter, Dr. Kroll, to try to determine a <br />compromise on use of his land. He explained that they had not <br />received a response. The next hearing on the application will <br />be January 12, 1994. <br />S. Joseph DiMaggio - Mr. Friel read a request for extension in <br />the hearing calendar. Mr. Friel moved to grant the extension. <br />Mr. Makunas seconded. All agreed. <br />Minutes - Mr. Friel moved to accept Minutes of November 10 and <br />24. Mr. Regan seconded. All agreed. <br />
