Partnership for a Variance V-93-5 A Petition was filed by Fields Point Ltd. Partnership for .a Variance from Sections 174-31 and 174-33 of the Zoning By-laws for permission to vary the set-backs to an internal driveway and to vary the size and dimension of parking spaces in a C-1 zoning district on property located at 39 Nathan Ellis Highway, (Map 74, Block 22 ) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Enterprise, a newspaper of general circulation in the Town of Mashpee on December 24 and December 31 , 1992, a copy of which is attached and made a part hereof . A Public Hearing was held on the Petition at the Mashpee . Town Hall on Wednesday, January 13, 1993 at which time the following members of the Board of Appeals were present and acting throughout: John J. Friel, Michael A. Makunas and Edward M. Govohl . The Board was informed that the applicant had an application as a Development of Regional Impact before the Cape Cod Commission. At the January 27 , 1993 meeting of the Board of Appeals the Board voted unanimously to suspend all hearings until the final decision of the Commission which was voted on March 4, 1993 . Notice was again given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication In The Enterprise, a newspaper of general circulation in the Town of Mashpee on March 5 and March 12 , 1993, a copy of which is attached and made a part hereof . . A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, March 24, 1993 at 7 :30 P .M. at which time the following members of the Board of Appeals were present and acting throughout : John J. Friel, Michael A. Makunas and Cheryl A. Hawver.
