(Owner of record: Christopher Burden TR.
New Seabury Units Nominee Trust) .
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee,
on April 9 and April 16, 1993, a copy of which is attached hereto and
made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, April 28, 1993 at 7:30 P.M. at which time the
following members of the Board of Appeals were present and acting
throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni.
Attorney Mark. 0 Gildea represented the applicant and informed
the Board that the subject lot was approved by the Mashpee Planning
Board in 1965 and was previously thought to be contained within the
New Seabury Special Permit area. The Subdivision Plan approved by the
Planning Board contains many similarly sized lots but not lots with
similar frontage. Mr. Gildea explained that the lot has-10' frontage
and is located at the end of a cul-de-sac on Summersea Road. It is
bordered on two sides by a reserve area-and without the reserve area
it would have sufficient frontage to comply with the by-laws.
Comments were received from an abutter questioning the proposed
location of a house and the Board was informed that this had not been
determined.
