Board of Appeals Joseph and Barbara Macaluso V-93-31 2. <br /> The Board of Appeals, after carefully considering all of the facts <br /> and evidence submitted at the hearing, made the following findings: <br /> 1. the subject lot is afflicted with circumstances relating <br /> to shape which differentiate it from other land in the <br /> zoning district <br /> 2. due to those circumstances a literal enforcement of the <br /> Town of Mashpee By-law would involve substantial hardship <br /> 3. relief could be granted without substantial detriment to <br /> the public good <br /> 4. relief could be granted without nullifying or substantially <br /> derogating from the intent or purpose of the By-laws. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on April 28, 1993 to grant a Variance allowing 10' <br /> frontage on land a 7 Summersea Road (Map 104, Block 83) known as <br /> Lot 142 on a subdivision plan recorded in the Barnstable Registry <br /> of Deeds in Plan Book 242, Page 51. <br />
