Gabriel TR. - V-93-72 <br /> A Petition was filed by Robert J. Gabriel TR. of <br /> Brockton, Massachusetts for a Variance from Section <br /> 174-32 of the Zoning By-laws to allow for construction <br /> of a single family residence on a roadway of permeable <br /> material in an R-3 Zoning district on property located <br /> at 2 Daniel ' s Island Road (Map 111, Block 23 ) Mashpee, <br /> Massachusetts. (owner of record: Christopher Burden <br /> TR. N.S . Units Nominee Trust ) . <br /> Notice was duly given to abutters in accordance <br /> with Massachusetts General Laws Chapter 40A. Notice <br /> was given by publication in The Enterprise, a <br /> newspaper of general circulation in the Town of <br /> Mashpee on August 6 and August 13, 1993 , a copy of <br /> which is attached hereto and made a part hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, August 25, 1993 at <br /> 7 :30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: <br /> John J. Friel, Michael A. Makunas and Edward M. <br /> Govoni . <br /> Attorney Mark Gildea represented the applicant <br /> and reviewed land court plans of three lots off of <br /> Wading Place Way in New Seabury which are included in <br /> the 1964 Special Permit. The plan includes a 20 ' <br /> roadway. <br /> He explained that the lots were reviewed by the <br /> Conservation Commission in 1992 and that the Order of <br /> Conditions allowing construction on them requires that <br /> driveways and roadways be constructed of permeable <br /> material . He stated that the Building Inspector could <br /> not issue building permits without a Variance from <br /> Section 174-32 . He said the applicant would maintain <br /> the roadway at 20 ' . <br />
