Gabriel TR. 2 . <br /> V-93-72 <br /> Mr. Gildea stated that the Building inspector <br /> could not issue a building permit without a <br /> Variance from Section 174-32 and said that the <br /> applicant would maintain the road at 201 . <br /> The Board of Appeals made the following <br /> findings: <br /> 1 . there are circumstances relating to the <br /> soil conditions of the land In question which do <br /> not affect the zoning district in which the land is <br /> located <br /> 2 . due to those circumstances a literal <br /> enforcement of the by-laws would involve <br /> substantial hardship <br /> 3. the Board determined that relief could be <br /> granted without nullifying or derogating from the <br /> intent of the by-laws <br /> 4. the Board found that relief could be <br /> granted without detriment to the public good. <br /> Upon motion duly made and seconded the Board <br /> of Appeals voted unanimously on August 25, 1993 to <br /> grant the Variance. <br />!� t <br />
